Tesla is being sued by the family of a biker who was killed when he was rear ended by a Tesla Model 3 whose driver was using Autopilot mode. The lawsuit was filed in Salt Lake City, USA.

The family of Landon Embry are suing the company on the grounds that the driver assistant software and other safety features were not fully functioning. As such, the car which was travelling between 120 – 128 km/h, rammed in Embry’s Harley-Davidson.

Embry, 34, was thrown off his motorcycle and died at the scene.

The driver of the Model 3 involved was deemed to be “tired and not in a condition to drive as an ordinarily prudent driver” in the lawsuit. The family’s complaint said: “A reasonably prudent driver, or adequate auto braking system, would have, and could have slowed or stopped without colliding with the motorcycle.”

This was not the first time that a Tesla was involved in crashing and causing harm to either the driver or another party while on Autopilot. In fact, Tesla had just settled another lawsuit after being sued by the family of a Model X owner who was killed when his car crashed into a median, whilst on Autopilot.

Many quarters including the US National Highway Transport Safety Agency (NHTSA), have called out Tesla’s Autopilot program, citing that it is not fully “auto” and still requires inputs from the driver. However, it seems that some drivers have taken the term to literally mean that they can lay back and take their hands off the steering wheel and feet off the pedals. Hey, even an aircraft’s sophisticated autopilot requires the pilots to monitor other systems of the aircraft and make decisions.

Malaysia’s Minister of Transport, YB Anthony Loke said that at least one in thirteen heavy vehicle drivers were found to be positive for drugs.

He also said, “In the Commercial Vehicle Special Operation from August 1 to August 4, a total of 21 drivers were found positive for drugs as a result of the urine test screening of 276 commercial vehicle drivers.

“We do not compromise with drivers who are not competent in operating commercial vehicles and public transport,” he said.

Therefore, his ministry wants to reform Act 333 (Road Transport Act 1987) in order to include stricter punishments for drivers who drive under the influence of drugs.

This is because the existing law is not strict enough in punishing drivers who take drugs, because the suspect cannot be prosecuted if he is not involved in any accident.

However, said Loke, if a driver is tested positive for drugs during a roadblock operation, only his license will be be suspendedin accordance with Section 36.

“The ministry is currently in the process of amending Act 333 but we see that there is concern in the use of drugs by drivers of commercial vehicles and based on the current punishment, we do not want to wait for accidents to occur due to the behaviour of these drivers.

“So it is necessary for the ministry to stop the activity of taking drugs while driving and I myself will discuss further with ministry officials and legal officials to see this matter from a stricter legal aspect,” he said.

“I don’t accept the term casually taking drugs while driving, because the effect is the same as those who are drunk, i.e. they will hallucinate and can affect driving, including speeding.

“These people may be using drugs to stimulate long-distance driving,” he said.

Meanwhile, in the Special Integrated Operation of Tourism Vehicles and Public Service Vehicles (Tourist and Express Buses) held from 2nd to 31st July, a total of 19,456 vehicles have been subjected to action.

“Out of that number, 667 vehicles were prosecuted, with 14 of them confiscated.

“As a result of the inspection of 2,547 sightseeing and express bus drivers, a total of 26 drivers were also screened positive for drugs,” he said.

A video recording of the incident has gone viral on the TikTok app. The video shows a group of residents in an area of ​​Kajang chasing the hearse, because they wrongly believed that the driver had stolen it and was involved in a burglary case in the district.

Kajang District Police Chief, Assistant Commissioner Naazron Abdul Yusof, said the 35-year-old man who was driving the hearse had made a report regarding the incident at 3.58pm yesterday.

“The man drove the hearse to a residential area in this district to be delivered to a mechanic, but got the wrong address. He had to drive slowly to find the correct location.

“His act of driving slowly caused a misunderstanding until he was stopped by a group of men who accused him of driving a stolen vehicle and being involved in burglary cases in the area,” he said in a statement today.

He said that the group of residents involved allegedly tried to attack and chased the man with wooden and metal weapons, causing the driver to flee with the hearse.

“A police check found that there was no report of missing hearse, and even the nazir of a mosque confirmed that he gave the van to the man to be repaired,” he said.

He said the case was investigated under Section 506 of the Penal Code for criminal threats and Section 233 of the Multimedia Communications Act 1998, due to a viral video that caused annoyance to the public.

Naazron advises the public not to speculate or make untrue statements on social media, especially those that may cause confusion or disturb public order.

“Strict action will be taken against any individual who tries to spread false information and news,” he said.

Isu berterusan

Ini bukanlah panggilan semula pertama yang berkaitan dengan relay penghidup R 1300 GS.

BMW telah menemui masalah ini walaupun semasa acara pelancaran pada Oktober 20243 dengan beberapa motosikal tidak dapat dihidupkan, atau motor penghidup berjalan sendiri. Isu itu dikesan kepada perumah relay penghidup yang membenarkan kelembapan masuk.

BMW mengeluarkan panggilan semula pertama pada Februari 2024 untuk menggantikan penutup plastik relay tetapi isu itu berterusan, menunjukkan bahawa pembetulan itu tidak berkesan. Jadi, satu lagi panggilan semula telah dikeluarkan pada Julai 2024.

Unit-unit yang terkesan

Dianggarkan sebanyak 25,000 unit BMW R 1300 GS terjejas, bagi yang dikeluarkan antara 14 Julai 2023 hingga 18 Mac 2024.

What triggered the campaign?

According to the safety report filed with the National Highway Traffic Safety Administration (NHTSA), the starter relay housing was produced with an insufficient injection moulding process. The defect may make the housing susceptible to damage during motorcycle assembly or a dealer maintenance visit, leading to possible moisture ingress. Consequently, this could lead to corrosion of internal electrical contacts in the relay.

Leakage of current between corroded contacts could result in heat damage to the starter relay. In rare cases, this could increase the risk of a thermal event or a fire. BMW states riders should be wary of warning signs such as the starter motor turning on its own, odour of overheating electric components, and even smoke.

Persisting Issue

It turns out that this is not the first recall related to the R 1300 GS’s starter relay.

The manufacturer had discovered it even during the launch events in October 2024 with several bikes not starting, or the starter motor running themselves. The issue was traced to the starter relay housing which let moisture in.

BMW issued the first recall in February 2024 to replace the relay’s plastic cover but the issue persisted, showing that the rectification was not effective. So, another recall was issued in July 2024.

Affected units

It is estimated that 25,000 units of the BMW R 1300 GS are affected, for those produced between 14 July 2023 to 18 March 2024.
